Terms of Service
Last updated: October 2026 • Governing vehicle buyers, private sellers, and UK motor dealers
1. About CarWebb & Marketplace Intermediary Role
CarWebb is operated by CARWEBB LTD (Company No. 17427407), registered in England and Wales at 334 Slade Lane, Manchester, United Kingdom, M19 2BL.
CarWebb operates as an intermediary hosting and search platform under the Electronic Commerce (EC Directive) Regulations 2002. CarWebb connects prospective buyers with independent motor trade dealers and private vehicle sellers.
Crucial Notice Regarding Transactions:
- CarWebb does not purchase, sell, broker, or take legal title or possession of any listed vehicle.
- CarWebb does not inspect vehicles, conduct pre-purchase mechanical diagnostics, or provide warranties or roadworthiness certifications.
- The contract for the purchase and sale of any vehicle is entered into directly and exclusively between the buyer and the seller (or motor trade dealer).
2. Age & Legal Eligibility
To register an account, publish a listing, submit an offer, or reserve a vehicle on CarWebb, you must be at least 18 years of age and resident in the United Kingdom with full legal capacity to enter into binding agreements.
3. Private Sellers: Legal Obligations & Warranties
Where a vehicle is advertised by a private seller:
- The transaction constitutes a private sale between two individuals. Consumer protections applicable to commercial trader transactions (including the implied statutory terms under Part 1 of the Consumer Rights Act 2015) do not apply.
- Private sellers warrant and legally represent that they possess unencumbered legal title and ownership of the vehicle, that the vehicle is not subject to undisclosed outstanding finance, has not been recorded as a total loss insurance write-off (Category A, B, S, or N) unless explicitly disclosed in the listing, and is not stolen.
- Private sellers must not make misleading or false statements. The Misrepresentation Act 1967 applies to private sales.
4. Motor Trade Dealers: Statutory Responsibilities
Where a vehicle is advertised by a commercial motor trade dealer:
- The dealer acts in the course of trade or business and is subject to the Consumer Rights Act 2015 and the Digital Markets, Competition and Consumers Act 2024 (DMCC Act 2024).
- On-The-Road (OTR) Pricing: Dealers must display transparent, all-inclusive vehicle pricing. Mandatory administration fees, documentation charges, or handling fees must be included in the headline advertised price. Dealers are strictly prohibited from demanding hidden or undeclared fees at the point of sale.
- Dealers warrant that vehicles offered for sale are of satisfactory quality, fit for purpose, and match their advertisement description.
5. Consumer Rights & Qualified Statutory Remedies
If you purchase a vehicle from a motor trade dealer as a consumer, your statutory rights under the Consumer Rights Act 2015 apply directly against the selling dealer:
- Within 30 Days of Handover (Short-Term Right to Reject): If the vehicle has an inherent fault or fails to meet statutory quality standards that existed at the time of delivery, you have a statutory right to reject the vehicle for a full refund from the dealer.
- Between 30 Days and 6 Months (Repair or Replacement): If a fault develops within six months of delivery, it is legally presumed to have existed at the time of sale unless the dealer proves otherwise. The dealer is entitled to one statutory opportunity to repair or replace the vehicle. If the repair is unsuccessful, you may exercise a final right to reject (subject to a reasonable statutory deduction for use) or request an appropriate price reduction.
- Important Disclaimer: CarWebb itself does not offer an unconditional or universal 30-day "no-questions-asked" return guarantee. Any contractual guarantees beyond statutory rights are solely the undertaking of the selling dealer or third-party warranty provider.
6. Vehicle Viewing & Purchase Arrangements
CarWebb operates as an intermediary search and advertising platform. CarWebb does not accept, hold, or process vehicle purchase funds or reservation deposits between buyers and sellers:
- All vehicle viewings, inspections, negotiations, and payments are arranged directly between the buyer and the seller or motor trade dealer.
- CarWebb does not operate an escrow service, deposit vault, or payment intermediation service for vehicle acquisitions.
- Prospective buyers should never send remote holding deposits or funds prior to in-person physical inspection and independent verification of vehicle provenance.
7. Search Ranking, Promoted Listings & AI Transparency
- Default Search Ranking: Vehicle search results on CarWebb are ranked based on objective relevance criteria (vehicle make, model, trim, registration year, mileage, and geographic distance from the buyer's search location).
- Promoted & Featured Listings: Sellers and dealers may purchase optional listing promotion features (such as 'Featured' or 'Top of Search' placements). Promoted listings are given algorithmic prominence in search results and dedicated display carousels. All paid commercial promotions are prominently and conspicuously badged with 'Featured' or 'Promoted' so that buyers can clearly distinguish paid placements from organic results.
- AI-Assisted Listing Features: CarWebb provides AI tools (powered by Google Gemini API) to assist sellers with draft listing descriptions and vehicle specification extraction. All AI-generated content is subject to mandatory human seller review and verification before publishing. The seller remains legally responsible for the complete accuracy and truthfulness of all listing statements.
8. Prohibited Platform Activities
Users are strictly prohibited from:
- Advertising vehicles with altered, falsified, or "clocked" odometer mileage.
- Advertising cloned registration marks (VRMs) or vehicles subject to police theft markers.
- Misrepresenting commercial trader activities as private individual sales.
- Demanding off-platform advance wire transfers for vehicle balances outside verified banking channels.
- Posting abusive, discriminatory, or fraudulent communications.
CarWebb reserves the right to immediately suspend or terminate user accounts, delist advertisements, and report suspected criminal conduct to UK law enforcement authorities, the DVLA, and Trading Standards.
9. Limitation of Liability
To the maximum extent permitted by English law, CARWEBB LTD excludes all liability for indirect, incidental, or consequential losses, loss of profit, or commercial disruption resulting from transactions between buyers and sellers.
Nothing in these Terms excludes or limits liability for:
- Death or personal injury resulting from our negligence.
- Fraud or fraudulent misrepresentation.
- Any other liability that cannot be excluded or limited by applicable law in England and Wales.
10. Governing Law & Jurisdiction
These Terms of Service and any dispute or claim arising out of or in connection with them are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction.
